These Terms and Conditions apply to the use of pacohallak.com and, in particular, to purchases of digital products such as downloadable sheet music and guitar arrangements offered by Paco Hallak.

2. Scope
These Terms and Conditions apply to orders placed through the online shop and to the use of digital products supplied through the website. Mandatory consumer rights under applicable law remain unaffected.
3. Products
Products offered through the shop may include digital sheet music, guitar arrangements and other downloadable musical materials. The product page describes the relevant work, format and price before an order is placed.
4. Formation of Contract
The presentation of products in the shop does not by itself constitute a binding offer. By completing the checkout process and submitting an order, you make an offer to purchase the selected product. The contract is concluded when the order is accepted or confirmed through the shop or the digital product is made available in connection with the accepted order.
5. Prices and Payment
The price displayed for a product at the time of purchase applies to the order. Available payment methods are shown during checkout and may include payment services such as WooPayments and PayPal where enabled.
Where applicable, invoices and prices are handled according to the tax status stated on the relevant invoice or checkout documentation.
6. Delivery of Digital Sheet Music
Digital products are supplied electronically. After successful order processing and, where required, successful payment, the customer receives access to the purchased download through the method provided by WooCommerce, such as the order confirmation, customer account or download link.
No physical item is shipped unless a product is expressly described as a physical product.
7. Technical Access
The customer is responsible for having a suitable device, internet connection and software capable of opening the stated file format. If a purchased download cannot be accessed because of a technical problem attributable to the website or the supplied file, please contact info@pacohallak.com so that the issue can be investigated and, where appropriate, access can be restored or a corrected file supplied.
8. Licence and Copyright
Unless expressly stated otherwise, purchasing a digital product grants the purchaser a personal, non-exclusive, non-transferable right to use the downloaded material for their own lawful musical and educational use.
Copyright and all other intellectual-property rights in original works, arrangements, editions, notation, recordings, graphics and other protected material remain with Paco Hallak and/or the respective rights holders.
9. No Redistribution or Resale
Digital sheet music and other downloads may not be resold, redistributed, uploaded to file-sharing services, publicly posted, reproduced for distribution, or otherwise supplied to third parties except where applicable law expressly permits this or prior permission has been granted by the relevant rights holder.
A purchase does not transfer copyright or ownership of the underlying intellectual property.
10. Defective or Incorrect Digital Files
If a supplied digital product is defective, corrupted, incomplete or materially different from the product ordered, statutory rights remain unaffected. Please contact info@pacohallak.com with the order details and a description of the problem so that it can be resolved.
11. Digital Content and Right of Withdrawal
For consumers, statutory withdrawal rights apply where required by law. For paid digital content that is not supplied on a tangible medium, the right of withdrawal may expire after performance has begun only where the applicable legal requirements are met, including the consumer’s prior express consent to performance beginning before the withdrawal period expires and the consumer’s acknowledgement that, by giving that consent, the right of withdrawal is lost when performance begins. Where required, the customer will receive confirmation of that consent and acknowledgement on a durable medium.
Any separate cancellation or withdrawal information presented during checkout or on the website forms part of the information provided to the customer and remains subject to mandatory consumer law.
12. Customer Information
Customers are responsible for providing accurate information required to process the order, including a functioning email address. Please check order and billing information before submitting the order.
13. Website and External Services
The website may contain links to third-party websites or use third-party payment and technical services. Those services are operated under their own terms and policies. Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.
14. Intellectual Property of the Website
Unless otherwise indicated, the website’s original text, photographs, graphics, musical content, branding and other original materials are protected by applicable intellectual-property law. Use of the website does not grant a licence to reproduce or commercially exploit those materials beyond normal use of the website and rights expressly granted with a purchased product.
15. Governing Law
These Terms are governed by the laws of Germany, subject to mandatory consumer-protection rules that may apply to the customer. Mandatory jurisdiction rules remain unaffected.
16. Changes to these Terms
These Terms may be updated for future use of the website and future orders when services, legal requirements or shop processes change. The version applicable to an order is the version in effect when that order is placed, unless mandatory law provides otherwise.
